When he was a teen, he was signed to play w a MLB team. But he was above age by one year. So by the advice of I don't know who, he was told to get his brothers birth certificate so he can make the age requirement. So he plays in DR for a MLB team for 4 years. Never made it to the US. And he just continued using his brothers name. For the last 6 years he has worked w a MLB team in DR as a scout. He evaluates players and signs him using his brothers name(I rather not say what team) anyways, he now realizes that is was wrong and immature decision to use his brothers name, and he wants his name back. The junta central knows about this they are giving him a hard time., they say they want to help, but they don't do much. At the moment he has no cedula. JCE canceled the one he was using while they were trying to fix it.
They have asked for papers of the team he was initially signed to. Baptism and school record, we gave it to them. They interviewed his mother. Everything they asked for, we have provided. Now they want to interview the brother. And hopefully after that's all done, he will have his own name and cedula and we can be married.

This will definitely affect his visa process also. He simply cannot lie because if they find one thing out of order they will most likely deny him the visa, He needs to make all this right before even thinking about obtaining a visa.

Does he still play for that MLB team or is he now a scout?

So does he sign  for the MLB team or does he sign under his brother name? If he signs under his brother name then he's not really a scout for a MLB team but rather an individual who tries to get said player on a MLB team.

Base on the information you provided I understand why the Junta would indeed give him a hard time in getting his own name and cedula back. Finally, going through the Visa process might be more challenging than what you're currently going though.

Good Luck-

He finally got his new cedula number with his real name last month.
Yes he is still a MLB scout for the team.  The MLB team is his employer.  The team will be submitting the Visa process for him to come to Spring Training in Feb/March.

We are getting married 12/19.  So we have to tell uscis/us consulate/NVC the truth.
He traveled to Colombia as a scout with his brothers name.

For the cedula you dont get finger printed.  But for his passport, yes.  The Junta Central says they will send notification to the passport place to cancel the old passport.  Next week he goes to apply for the passport.

Thanks for the input...i appreciate it all:)

If I read what you wrote here correct...... His team is filing a visa request for him to come to the U.S. for spring training? Weeeeell, if you guys are married, just know that there is a possibility that he could get denied that visa. Their reason would be that he is married to someone living in the U.S. and could easily decide stay in the U.S. and not return to D.R. once that visa expires. They would consider that a high risk for fraud.

It doesn't mean that this WOULD happen, but it has a high possibility of denial.

In a case like that, you guys would be better off filing a residence petition.

We did not even think about his work visa being denied if he is married to an american.  But you are right there is that possibility.
I am still filing the residence petition as soon as I have the marriage certificate.  I was thinking that with the work visa, he can come and visit me until the CR-1 process is complete.

If you have a residence visa in process, they probably won't process a work visa at all. If he ALREADY had the work visa, you might be able to adjust status from that to a resident visa, but it is a bit of a risk.
