visa denied
« on: June 24, 2014, 07:14:01 pm »
i petitioned for our 13 yr old nephew to come visit for 3 weeks during the summer.  He was denied.  I spoke with his parents and was told that apart from a copy of his passport and the appointment letter the officer did not look at any other documentation.  Before setting the appointment we gathered what we thought was sufficient evidence for a favorable response.

My questions is to those with more experience is does anyone know if by getting a congressman office involved have any of these cases ever been approved after further review?

A visitor visa from D.R. is extremely hard to obtain. It isn't likely that getting a congressman involved will change anything. Only about 1-2 of visitor visas get approval, mainly due to the fraud rate out of D.R.

I wouldn't say it's realistically that low, it's about a 41% denial rate from the DR, which is up a whole 10% since the last time I checked in 2011.

I will say that getting a congressman involved is a waste of time though. Unless that child can prove through assets in HIS name, a steady job to come back to in HIS name, etc, which obviously wont happen, the chances of him getting approved are like, 0. It's unfortunate but so many people have ruined it for the people who genuinely wont abuse the visa.

i totally read d-mo post wrong i thought he meant 1-2 % chance.  41 % makes more sense.  and yes unfortunately he only owns a bike and computer lol. just thought they would consider affidavit of support and his parents backgrounds but apparently that was not the case

Na, you read it right. I wrote it wrong.

The issue with visitor visas for minors is that a lot of parents in D.R. would send their children to LIVE with a relative in the U.S. illegally this way. I've even seen parents try to do things like use a BC from a deceased child and have their child assume the deceased child's Identity so that they could get their child into the U.S. this way.

I'm going to have to do something I haven't done in a long time. Give you the speech about "non-official" web sites.

There are tons of web sites out there with pie in the sky statistics. There is no source listed for this and I highly doubt it's even close to being accurate. My policy on this web site is that we usually ONLY accept statistics and information from "Official" sources like USCIS and the state Dept. There is a big reason for that and that is because most of the other sites have an agenda whether is be that they are an immigration lawyer's web site or some other conflict of interest. We generally want people to cite their source for statistics for that very reason. Our experience has been that the 1% approval rate that D-mo posted is fairly accurate. This figure was confirmed by Chief Consul William Bent when he was in that office. At that time, we had a very close relationship with Mr. Bent and the consulate and learned a whole lot about this process. I even had a behind the scenes tour of the Consulate and got to meet our Ambassador at the time.

thanks tim i wish i would have know that before i spent $400 to get the paperwork together lol.  honestly the denial does not bother me as much as the officer not looking at one piece of paper and then not having any recourse to as why the officer made his decision without looking at anything.

Unfortunately this is SOP for them because they don't have time to look at every piece of evidence you bring for them especially if you are a person who they think will stay in the USA. This is the way they are with almost all the applicants.
