hello everyone. I am Nai. I am engaged to marry a Dominican man in DR in November 2015. I have no idea what i am doing and i am very nervous. Has anymore done this before. Marry someone first in DR and then apply to bring them over as your spouse? Can someone walk me through what i would need to get married in DR and where we would go. Thank you.

Okay here is my story I guess lol:
I am U.S. born citizen living in PA. I love to travel and I work with a company that allows me to travel and work. While working in DR 5/2013 I met a Dominican man from La Romana. I have been back every 2 months since 5/2013. We got engaged 7/2015 and we picked a wedding date of 1/2016.

I just want to know what to expect in a wedding there. And make sure i have all the right documents i need when i arrive in Jan 2016 for our wedding. I don't want to get there and there's a problem .

In your first post you said that your wedding date was in November 2015. In this post you said January 2016. Did you decide to change the date?

1. I have been married before and I have my divorce decree. He has not been married before.
2. I have no police record. He had a run in with the police in República Dominicana and he is working to see what needs to be done to get a letter of good conduct. (But is that needed to get married in República Dominicana? I know it is needed to apply for visa to bring him over to the states but I didn't think it was necessary to get married in his country? Am I mistaken?)
3. Yes we changed the date the morning I replied to your message due to my work and his work schedule along with family members conflicts of schedules to come down to República Dominicana for the wedding. Everyone finally agreed Jan (after everyone is recovered from New Years drinking) is a more agreeable date.
4. Civil wedding.

Hi. nai.  Do you know what his "run in" with the police was about?  If you don't you really NEED to know. Some things will cause an automatic ban from the United States. Not trying to scare you or anything, but you really do need to know. Also, if he tries to pay someone money to get ride of what ever is on his record, it won't work. He may be able to get it off his record in D.R., but it wont go away from Interpol.

No, you don't need a police report to get married in D.R.  But it is best to have your S.O. ask the person who will be performing the ceremony what they require.

There is supposed to be a standard across the DR on the procedures necessary to get married. As is common in the DR, some folks "didn't get the memo" or does plain do not follow the prodicol. Since you are having a civil ceremony you will be married by a judge. After you decide on the location for your wedding, go to the local judge's office and make arrangements for him or her to officate at your ceremony. Of course you have to make sure they are available on that day.

After you get that nailed down, ask specifically what documents the judge wants to have. It can vary from one place to another. Most likely you will probably be dealing with the judge's secretary. Judges are busy don't you know?

You will probably need a copy of your passport, a legalized birth certifcate, a legalized divorce certificate and a "letter of singleness". Basically a "letter of singleness" is a document that you sign saying that you are "single" and legally able to marry. Hubby will probably only need his cedula and the "letter of singleness". Some places might also ask him for a legalized birth certificate.

FYI, I don't know if this applies to you but please note that since you are divorced there is a law about divorced people marrying. A man is able to marry a day after he is legally divorced. A woman has to wait 10 months after the day she is legally divorced. Why? to make sure that she isn't pregnant with her ex-husband's baby. This goes back to the "old days". As you can imagine this has not sat well with women. Most feel that this law is sexist and discrimitory. If I am not mistaken, I believe that this law was repealed recently. Still, as I said before some people don't "get the memo" or just plain and simple does their own thing. If this might be an issue you should check out what the local judge says.

You will also need to have two people sign as witnesses. Usually these people are the best man and the maid of honor. Some judges won't allow family members to act as witnesses. Check it out with whoever is performing your ceremony. The witness also need ID. If they are Dominican they just need their cedula. If not, the judge might ask for a copy of their passport. Find out what the judge wants.

No, your fiance does not need a clean "letter of good conduct" to get married, but he does need one in order to be granted a visa. Something to think about. It's best to get that straightened out as soon as possible.

Just to add; a minor judicial issue does not constitute automatic denial for a visa. But a serious crime like a drug charge or "crime of moral turpitude" won't fly at the embassy.

thank you so much! I and going back down in September and I plan to personally see what the judge will say. I am nervous about the 10months divorce law. I was told and read that its to the discretion of the judge and wavier had to be issues by the judge to waive the 10months . I had to wait 2yrs to get divorced in my state and it has not need 10months yet! Only 6 so I am praying he waives this!

and his run in with police was not drug or murder or weapon related. He got into it with a cop outside a shop and drink and should have kept his mouth shut and landed in jail!

I love him. And I love DR. I would love to bring him to this country but if I can't I am willing to be where my husband is. But lets hope that's a last resort. Lol thanks again.

As far as the 10 month thing goes, as I said I believe that it has been repealed,but as I have also said the locals like to think that they know best. I knew someone in the same situation. Had to chase her ex down after 5 years and finally got the divorce signed after a lot of stalling on his side. When she wanted to get married it wasn't 10 months yet. The judge agreeded to sign the waiver if she took a pregnancy test with a DR doctor and the result was negative. She did, it was, and the judge signed the waiver. Maybe my little story might help you.......

In a case like that, I seriously doubt you'd have much issue at the Embassy, the charge probably equates to our public drunk charge here in the states. I wouldn't try to cover it up though. If the case is thrown out of court, then fine. But don't try to hide it at interview time in the event that it is asked about at the Embassy. Reason being... if they ask about it, they typically already know anyway. The worst thing you can do is lie to a C.O., you are under oath while speaking with them. Purgery is a felony charge...... result, no visa.

 As far as the nine month marriage rule, some Justicias stick to it, some don't. Your best bet would be take all your docs down to set up the wedding and Keep your lip zipped about the old and useless 9 month wait law, DON'T even ask about it! If the Justicia brings it up, then discuss it and come up with a solution.

Thank you both again! I would never try and lie and cover up his run in! That would be a def no visa result. Like I said we will be honest and do things right and if all else fails Im prepared to stay with my husband in República Dominicana until things change. I miss him dearly and even though I just left him july19th I just bought a ticket for August 20th. September is to long to waits ❤️
