New to this...I need help with the process to marry in DR

Hi everyone,

I am very new to this forum and am a little nervous.

I met a man on my vacation to DR in 06/2015.
I went back 08/2015 for a visit (2nd trip)
I went back again 02/2016 (3rd trip)

We decided to get married...and I am nervous...about the entire process. We want to get married in July ~8-13, 2016 (somewhere in there).

Background info: I was married, divorced over 12 years ago. I have 1 child. I live in Texas. He has never been married and has no children. He is from Rios San Juan.

What do I need? Here is what I have been able to gather from just searching endlessly, but I am still not certain.
-Birth Certificate
-Divorce Decree
-Affidavit of Single Status (where do I get this?)

Ok, so then after all the mentioned paperwork is obtained what do I do? Get it notarized? Get ig apostilled? Get it translated? And where do I get this done? Here or DR?

Any and all guidance would be much appreciated!!

You need to get your docs Apostiled and translated. The Apostile is done here at your State Dept. and the translations you can get online. I have to look but there is a service I used that is very good and charges $20-30 per page. I will check it and get back to you here on your post. Good luck!

Tim got most of your request.

Single Status letter is easier to get in D.R. in my opinion. All it is really is a sworn affidavit that you are single and eligible to marry. It has to be legalized.  Cheap in D.R., about 1500 pesos last time I checked around.

The worst part is the waiting. Just break everything down into steps and go step by step. It may seem daunting, but in fact it is very doable and is ten times easier today then it was 5 years ago.

Do I need a prenup? It's been recommended to me several times.

Does anyone know if they stand up in DR and US?

Does anyone know who I would have to speak with?

I would like to add that I have no real assets but do have something set up for my son. I really want to make sure what I had prior to our getting together will go to my son as previously planned.

Also, I have spoken with him about it and he says he is fine with it (the prenup).

Any info would be greatly appreciated.

Some do it, some don't. I guess it really depends on what you got to lose  :rotfl: If you feel you need one, then you need one.

Yes and yes

A lawyer. If you're getting married in D.R., one there. If marrying here, then one here.

That can usually be taken care of without a prenup. If it is a bank account, appoint your son the sole beneficiary of that account. In that case, the only person that would be able to access said account would be him......and/or his legal guardian..... period. You can also add to that, a will and appoint someone trustee that you REALLY know you can trust. As long as it was there before you married, a spouse can't legally fight for it because it's already set up.

Also, I have spoken with him about it and he says he is fine with it (the prenup).

Any info would be greatly appreciated.

Hi, I answered you in red above. Also, you are female, unfortunately, courts do not favor men too much when it comes to marital stuff like that.

One point to make. During this process you (or a co-sponsor) will have to sign an AOS (Affidavit of Support). This is basically a document saying that you (or your co-sponsor) will be financially responsible for the person (or persons) that you petitioned. This is a very serious document and is very difficult to null and void (meaning it is very difficult to get out of). Very few things ends your responsibility. Divorce does not. Even if you divorce you are still financially responsible for the person or persons that you petitioned. A prenup will not cancel out this responsibility. This is something to think about very carefully. I wish you good luck!
