Help me :) New to all of this

Hi Everyone,

I have been dating my boyfriend, Elias, (who lives in the Dominican) and recently we decided that the best place for us to live is in the United States.

After much research, I thought I would bring him here as a fiancé and file the i-129 and then the k1.  After more research, it looks like the faster way to get him here is to marry him in the Dominican and file a i-130 and then do a k-3 visa.  What do people suggest?

I am really open to suggestions as we plan to marry either way.  I am truly trying to find the best option for us with the fastest time for us to be together.. I know it is a long process either way WITH LOTS OF PAPERWORK!

You would be doing the CR1 and the form you will use will be the I-130. You would do this AFTER you get married in the DR.

The following is how either of those petitions would apply to you and your SO.

If you filed a petition now:
 
The petition form I-129f is for Fiance (K-1 visa type). The same form is also used for early entry of a family member (K-3 visa type) to wait for residency application to complete while inside the U.S.

If you get married before filing a petition: HIGHLY RECOMMENDED

The petition form I-130 is a for family member residency, which would be spousal for you. In your situation it would be a CR-1 visa (married less than 2 years). CR-1 is a conditional residence visa good for two years. After 2 years you will have to file to "lift conditions", which would convert the visa to a IR-1, which is the normal 10 year residency.

Your spouse would be eligible to file a form N-400 petition for citizenship after residing in the United States for 3 years being married to the petitioning U.S. citizen.

Filing an I-129f for any reason is just about useless these days as it takes pretty much the same amount of time to process either way (about a year). If you filed an I-129f, once arrived you would have 90 days to marry and then file to adjust status. That would then give you the CR-1 for 2 years on top of the time already passed......Which by the way, he would not be able to work or do much of anything else legally until either a permission to work was approved, or the status adjustment is completed (anywhere from 6 months to a year on average usually the longer time), and THEN go through the rest of the steps to gain actual permanent residency.

 It's way cheaper, far less complicated, less stress on you, your SO, and your relationship to go ahead and get married and then file the I-130 for your spouse. This way, the day your spouse enters the U.S. they are eligible to work, drive (if they can get a license), go to school even.

 I don't know of many Dominican men who could come here and just sit around for 6 months to a year with nothing to do without going bat shit crazy and taking you along for the ride!

Welcome to the site! Please feel free to ask away. EVERYONE was new to "all this" at one time. If you are absolutely sure you are going to marry your boyfriend, then the best, easiest, less complicated, and less stressful route to go is to marry in the DR and file the CR-1. My opinion anyway. thank you all so much! So get married in dominican - apply for cr1 visa with form i-130.
now to get  married in dominican:
birth certificate for each, affidavit of marital status (single) for each, photocopy of valid passport for each, photocopy of national id card, two witnesses with valid passport or valid national id card - every document needs to be notarized and translated into spanish for marriage in dominican
To get a head start on visa/documents he needs:
buena conducta, birth certificate, update passport, cedula de identidad personal, judicial/arrest/prison records

You sound like a pro!  You will also need a certified copy of any divorce decrees if either of you were married before. If you want to plan way ahead don't forget to get your financial documents in order. But, you have plenty of time for that.

To get married in D.R. it's best to have your SO contact the person who will marry you to get a list of exactly what you need and how it needs to be done.

Understand, there is a specific process and a specific list of required documents, BUT some Justicias didn't get the memo and they don't require quite as much.

Some require you to have everything exactly as specified..... like an apostillized Birth Certificate. By Dominican Law, they want it that way. BUT, as I said, some Justicias didn't get the memo and notary is sufficient. Of course, everything in English will have to be translated.

Letter of single status is best to have done by a lawyer in D.R., it's simply a sworn affidavit stating that you are single and eligible to marry. Depending on where you go to in D.R. some of us have legal contacts that we can get you in touch with. For example, my wife and I have a lawyer in Santiago, she is awesome and cheap.

Plus for marriage i like that he can work right away in us and travel back forth. I feel that with fiance visa he can come over sooner but wont be able to work either way i need to decide - he just wants whatever is going to get us together faster. Understand clearly here so you don't get surprised. I just posted the pros and cons on another thread here somewhere....

 He will NOT get here any sooner with a fiance visa. Almost no one uses the I-129f anymore specifically because the processing is almost exactly the same either way.......about a year.

With a fiance visa it will be quite some time before he would be able to work or do anything at all once arrived here.
