I agree with everyone here.  Before we got married hubby went to find out what I needed from here and then when I got there with what they wanted it was not taken.  They prefer when things are done in DR, speak to the judge marrying you and they will help you.

*NOTE*
I edited my post to include my birth certificate,  because, the lawyer (notary) did use the info from my birth certificate when typing my single status letter.

..... just trying to be as specific for you as I can in the details.

You don't have to get ANYTHING done at the US embassy so me asking won't do any good.I know you want a good solid answer but unfortunately unless you speak directly to the judge marrying you, you won't get one.

The only reason why I want to make sure I do it right is so that when we go through the CR1 process we have no additional problems or missing steps...

Right now I am getting a copy of my BC in town (through a friend - my mom gave him all my details to find it). So when I go next week I'll go pick it up. I'll apply for the cedula just to have it when I go back in August.

I am also placing some calls to find out who the judge will be through a family friend that is a lawyer in my town. I will speak to her about the SSL vs my current US divorce decree. I assume it will be easiest to have her type up an SSL letter for me once I am there rather than to have the divorce decree translated. But I'll ask...

Im so glad I dont have to deal with going to the Embassy tho!

OK Dorie.... errr I mean TallDrink  rolling on the floor laughing Just kidding! But really, it's almost de'javu!!!

You are making this WAAAAY harder than it has to be! If you have a SSL you don't need a divorce decree. If you have a US passport, you don't need a cedula or a Dominican BC. Your best bet would be to get the SSL. IN DR ( RD $500  max...and no need for translation)! Pay the money that the judge says to pay and get married RD $3000, 6000, 8000.... whatever, it will still be cheaper than all the mumbo jumbo you are trying to do!

There IS a Legal process to marriage in DR, but NO ONE follows legal process to the letter in DR... if it all!

LATER, if you REALLY want your Dominican BC & Cedula, just take a day trip to Santiago or Santo Domingo.  You can get your BC (legalized even)..AND your Cedula in the SAME OFFICE. Take a number for your BC, then go take a number for your cedula. Sit down in a chair and wait for the number for BC Give your info and state which format you want (and purchase 2 copies)! Go sit in a chair again and wait for 10 minutes... go get your proof copy when they call you and take it to the Legalization window, give them the proof copy and pay for two legalized BC copies.... go sit down in a chair for 15 minutes. They will call your name and give you your freshly printed legalized BCs. THEN, walk 10 whole feet over to the Cedula window and give them 1 copy of your BC (you won't get that one back) and tell them you want your cedula. Pay for it, put the other copy of your BC in your purse for safe keeping and sit down and wait for them to call you for Cedula photo. Sit in the chair again for another 20 minutes and they will call you to come sign for and pick up your freshly printed cedula......

But all this is ONLY if you still want this stuff after you get married.

D-Mo - not sure if you actually read my very last post cause you said way too much!!

In short:
Someone (else) is gettig my BC for me.
As advised, I am finding out who the judge will be so that I can talk to him directly when I go next week.
I am going to ask my lawyer friend to type the SSL letter up for me (rather than going with the divorce decree).

This is what I wrote earlier today, Where did I confuse you after my last reply??

I wasn't foncused by what you wrote.......I read it completely and understood it, I was just tellin ya that you don't need your Dominican BC and/or Cedula to get married.... IF YOU HAVE A US PASSPORT. I was assuming that your laywer friend is in the US and not in DR, in hich case it owuld need to be legalized and translated for use HERE..... You can get that same SSL here in DR, no need for translation in about 30 minutes time.  The last part I wrote for ya just in case you just want to have the BC and Cedula when you don't have to be in a rush.

Does that clear things up?

Since you are the petitioner, you also will not need your BC at the interview or anywhere else in the process, but instead, you will need either your naturalization certificate OR your US passport. What D-mo is trying to say is that you don't actually need your BC and especially your cedula for ANY of this. You could conceivably get married and do the CR-1 without ever getting any of these docs.

when i got married, they asked for my birth certificate but i didnt want to give up my only copy so i talked to the judge and he a copy of my passport. the day after we were married they got a surprise visit from some auditors who were makig sure the new JCE in santiago was getting their documents right. the judge called me personally and told me he needed my birth certificate ASAP before they looked through the files that had been done throughout the previous week. luckily i had mine on me.

more proof that they don't follow their own rules. according to law they're supposed to get a copy of birth certificate no matter what but most of them don't care(unless their job is on the line, lol)

EVERYONE that my boyfriend asked about this and EVERYONE else that I have asked said that I do need my BC. I was also told by the people in my Town Hall (all 3 that got on the phone) and the lawyer (in DR) that I needed my BC - This is why i am having someone getting a copy of it for me in DR now.

If I am not asked for it or dont use it, thats OK cause I actually dont like the fact that I dont have one on hand as it is - so it wont hurt to get it and have it with me. So this is a playing it safe move if anything.

ok, no problemo!

So why did you post this thread again?  None of us on DTTUSA knows what the heck we are talking about in the first place. We would have to have gone through some of these processes already to know anything. None of us here have done that.

D-mo, there's only so much you can do. Beyond that, it's fruitless. She's gonna do what she's gonna do. I still have a hard time that she doesn't understand that most of the people you get on the phone only know what they were "told" by someone else who probably doesn't know either. The only person who really knows is the judge who is marrying you. How would they even know you were a Dominican citizen if you only gave them your US passport? Easy as pie. Just get married as an "American".

D-Mo, I posted the thread to get an idea of what I needed and I got my answers. I have in the process shared the answers that I have gotten on my end - which I know are all over the place, but this along with what the others here have posted, only proves what Tim said, that they will do what they want to do at the time we get married anyway.

I have taken the advice to find out who the judge will be so that I can verify directly with him what I will need and not have any issues.

The only consistent theme is that I can get married with my passport as an American. However, I know I dont need my BC to get married, but since I dont have a copy at all, I am getting one to have for my records. Apparently, some peole have been asked for their BC as well, so if I have one on hand, at least I have covered my bases.

And so I did exactly what everyone else here does - I asked, I got answers, I shared my own experience with the answers that I got and I am also taking the advice posted here. From what I understand this was the purpose of this message forum - so tell me what is fruitless on MY part?

If you are finally going to tallk to the judge who is marrying you, then nothing is fruitless.

As  you guys have answered here - ALL very conflicting!!

Called the consulate - need a birth cert and passport and i can apply for a cedula in NY.
I will try to get a copy of the certificate when i go in two weeks.

I understand that you can only get a cedula right away if you already had one - I never did before.

D-Mo, did you have a cedula before?

Tim -  I am DR born, I cant just use my passport.

I'm a naturalized USC also, and that's all I need to get married in POP...

Yes, but things are different when you are DR born .

Talldrink.. I wished I had read your post earlier because I was in a similar situation when we tried to get married.
I didn't have a CEDULA, so I had to file for one. I went and obtained a copy of my BC, and had to go to the MAIN JCE in Santo Domingo to expedite the issuance of the cedula, because without a CEDULA #. You can't get married!!!. It doesn't matter if you are a USC. All this paper work took us TWO days!!..

If you were born in the U.S ,or outside of DR things are different..

BTW, I was not ask to provide a  letter of Single status ... I guess it all depends on the Judge or the civil office you go to.  If your SO has a cedula, it will say her/his marital status.

Hello again all, Just came back from DR - Miss it and my baby more than ever!! Cant wait for August already!

So wanted to update on the questions and answers I gathered.

Regarding needing a BC - if you are Dominican born you WILL NEED A BC. You can get it in DR or in the consulate here in the states. I was able to get mine in DR (paid someone 500 pesos, and it was handed to me as I landed YAY!)

I applied for the cedula in Paterson anyway since this is something I needed to do for something else anyway... I will have it before my wedding in August - Supposedly by July.

OK, let's assume this is true. When I got married I showed my US passport and they NEVER asked me if I was Dominican. I do know quite a few blanquito Dominicans, and they could easily pass. What I was saying was the "don't ask, don't tell" policy. Females seem to have a problem keeping their mouth shut and then they miss out on the opportunity to short cut some things.
