Uh,, is your brother in law a USC?, he first has to start with filing the I-130. If he is not a USC then it will be a 5-7 years wait, how things are in the DR it can be even more.

let say he is not a usc now and when he do the paper work and send it out then become usc what happen to his case ??

Tell him to start with the I-130, you can download that form from our download section on the left hand side of your screen.
We also have a sample I-130 that he can use as a guide to fill out the form.
Send that form in with the appropriate fee and that will start the process

He can start now and then his case will be upgraded when he becomes a citizen. Even then it will take a long time....
