What are some reasons that visas can be denied?

In the previous version of the site I know there was discussion about Dominicans who may have had a judicial case here in the US prior to the filing of the petition.

I also remember Tim mentioning that someone only went to visit their Dominican spouse ONE TIME.

Any others?

There are many reasons a visa can be denied.  For most cases however a waiver may be filed.  The reasons for denial are listed in the Field Manual for Consuls which Mr. Bent provided a link to in our previous version of the forum.  Here is further info on this: http://www.usemb.gov.do/Consular/iv-faq-refusal-e.htm

In every case I have seen, there was a legitimate reason to deny the visa. Of course 90% of the time, the petitioner and benficiary try to come up with some flim flam excuse or thye say they don't know why. They do, they are just too proud to tell anyone. I can understand that.

Hi Folks

Being in this situation really hits home.
There are many reasons for denying the visa, but the number one issue here is if your SO is not totally honest with you.
In many many cases problems can be rectified, but you need to do this ahead of time.
If they have had legal problems in the US, have a lawyer get a copy of the court record before you do anything else.
As with several of our members that were not aware of all the details, they went through the entire process and thousands of dollars only to find out, that their SO's visa would be denied permanently.

I remember there was a thread on the old board regarding a member whose SO was denied permanently (I believe).  Any updates on that?

Their only option was filing an appeal. Not sure if they will be doing that. If you are talking about the recent case the Fiance had already been in the states before.

But there have been other cases denied because of certain misconduct in DR so it goes both ways..

It could be theft, robbery, domestic violence.. the application states in the instructions many of the reasons you will not be elegible to apply

If Caimitera and I are talking about the same member, the visa was denied even after the appeal.
There is no recourse for them, the last I heard, she may be moving to the DR

It is but when you know something about your SO that may hinder the visa approval you need to have a plan B. Your SO was leaving everything behind to be with you.. you can also make the same sacrafice if need be.

Update on our case, I spoke to a lawyer and he found out he has absolutely no chance on coming back, based on his previous background.

I'll tell you this, if anyone has a fiance/e' or husband/wife that has been here before and had a criminal background, if the beneficiary pled guilty to the case, don't even think your getting the visa, even if the case was a misdemeanor, or even smaller than that. My plan B is to move, not anytime soon MAYBE in ten year or more...or who knows, maybe I'll just get tired of all this..

I am sorry to hear there are no further options for you stateside. I guess you don't have to answer this but since your saying 10 yrs and that you may get tired of this are you giving up on the relationship? Why you have fought so hard for this don't give up now
