Good night all!

For the tax experts here... I am now in the process of doing the 1040X. This is because my husband was still not in the USA when I did my taxes for 2008 and I did not request an EIN for him.

My questions are..Do I have to put his foreign income, which is less than $6000 US? Also, do I need to include any proof of his income? Finally, do I have to include an amended 1040 (along with the 1040X)?

#1, It's is not an EIN, EIN is an Employer Identification Number, you are referring to an ITIN, some people call it a PIN which is also incorrect but it's a generic street name for the ITIN.
If he's here already apply for a SS number and use that instead, or wait until he has it. It will be easier in the long term, switching numbers from year to year can cause problems.

#2 PM me on that. Foreign income of $6000 is excluded it's below the threshold.

#3 Amended returns REQUIRE a revised copy of the tax form being filed, in this case the 1040X is like a cover letter with totals and an explanation of why it has been filed, the new 2008 1040 you are filing is attached behind the 1040X, amend your state return as well.

Thank you for your reply.  About the EIN thing...I am still laughing. Is just that I get so many calls from employees inquiring about this number that it is just too fresh on my mind. Thank you again for your response Surftosalsa.

My tax preparer refused to amend my taxes for 2008. According to her, since my husband was not physically in the USA, I cannot do such amendement. But since I am a DTTUSA member, I knew that she was wrong. I'll try to do it myself using TURBO TAX, but I am afraid of doing something wrong.

Turbo tax will not LET you do it wrong. Just do it. Step by step you will be guided through it. Most preparers use the TurboTax commercial product. Same thing.

Tim, sorry, almost the same thing, close, but no cigar!
For a regular person preparing one or two returns TurboTax is excellent.
I have the ProSeries version from Intuit, they also have 1 or 2 other product lines for professionals. ProSeries reads TurboTax data, so a taxpayer can save money by starting the process on TurboTax and I can finish off the return in ProSeries.
