Hola, mi nombre es Yazmin-

Conoci a mi SO en el 2004 cuando el entro ilegal mente a Los Estados Unidos.

He went back to Dominican Republic in April 03, 2009. I went down and we got Married a day after our son's Birthday on 04/23/2009. I put in his I-130 in June 30, 2009 and everything is going right on track. They just finished his case and are waiting to schedule the Interview.

My concern is, what are our chances of getting a yes on that day, and when should we summit an I-130 for him. Please let me know if you think this would be possible. ( by the way, he never got into trouble while being here and our child and myself are both USC).

The form I was told I need to fill out is an I-601- its a waiver, Its just that I am not sure when should I summit it.

Is anything out there that has been or heard of this scenario??

Yes he can fill out a waiver, but it's still difficult for a "pardon" to be granted.

Yazmin, I'm a little confused about your situation. 

He successfully entered the US illegally in 2004 and willingly left in 2009?   Huh?  So, he didn't get deported???

How did he enter and subsequently leave?   Huh? Fake documents? Huh? 

I know you say that he never got in trouble while here, but if you're asking about the waiver I'm assuming that somehow the authorities know he entered the US illegally and there's a record of that??  Huh?

thank you for taking the time to try to help me,

he was never deported or arrested, there was a time in 2004 were he was a passenger when his friend got arrested for speeding and eluding the police.

he was finger printed and let go the same night because he was not driving. so we are not sure if they kept that record (he had a different name). so just in case we decided to admit to the fact that he was here.

He came in threw Mexico in 2004, but in 2009 he was tire of being here without seeing his family, so we decided to try it.

Was your I-130 approved?  Did you disclose all the info in the original application? 

He entered without inspection.  So, he will need a waiver and it should be prepared and submitted at the time of the interview. Get a lawyer to help you through the process.  It's not a lost cause if everything is as you say, but not something I'd do on my own.

we have a successful 601 waiver case on the site BUT it took a long time to get it approved and many hardship requests later it was granted .. took them @ 2 years if I am not mistaken

He left PR willingly and had no record .. and a common child also

Again this is one case of many but you will need help .. You can get an approval BUT the visa issuance is another thing altogether

Be prepared for a long wait

you have to be TRUTHFUL and HONEST >> anything can be in the system including traffic (moving) violations especially if they were fingerprinted

If you LIE and say you weren't here and then it comes out that you were that is an AUTOMATIC DENIAL and BAN from USA

It's an automatic ban anyway, it's just a question of how long, 3 years, 5 years, 10 years or life.

You need to have the waiver ready for the interview, but like BRK says, for this you should have a good immigration attorney with EXPERIENCE in DR immigration.
