Back in September 2009 my fiance started working to get his birth certificate.  HE tried to get it from an office in San Pedro but they told him he had to go to Santo Domingo.  He was sent back and forth a few times and then finally was told that it had been lost in transport between the two cities and that due to identity fraud he would have to find evidence of his birth and they would give him a new one.  He went to the hospital where his birth was reported, submitted school records and everything and they told him wait a few weeks and it would be ready.  Now his interview is March 3 and his birth certificate is still not ready.  How can he get a passport and id if they will not issue him a birth certificate?  He has an id currently, but of course the birthday on it is very wrong.  What to do?!?!

Unfortunately this is something that needed to be fixed PRIOR to you petitioning for him.

My husband had an issue with his name so I made sure he got the BC BEFORE I petitioned for him so that we wouldn't run into having the wrong name or birth date on the petition

If his cedula has a DOB on it then it was obtained from the BC as that is the only way that one is issued in DR

You have to offer some $$$$$$ to get the BC expedited ASAP besides that there is nothing else but showing up the day of the interview and leaving the case under Adminstrative Processing IF you take acceptable proof of his identity

He says that he has offered the person money, but she keeps saying that she is still working on the issue.  Maybe he has not offered enough?  I don't know what he should expect to pay for expedited services since everything in the US has a price, but at least they tell you what that price is.  Anyway, I did not realize this was going to be an issue until after I had already filed the petition for him because he was told one thing before I filed.  It wasn't until after I filed that he found out that his original birth certificate had been lost.  Ever since then, they have been giving him the run around to get the birth certificate.  I knew about the birthdate being incorrect on his national id and I wanted to just use that date and forget about trying to change anything, but he wanted to at least try.  Now it looks like this is going to bite us in the butt.  Even if he gets the birth certificate this week, how long does it realistcally take to get a passport and new id?  Is it better to try to reschedule the interview or just go ahead with what he has?

San Pedro has the record.  It may not have made it to the central registry in Santo Domingo, but if his birth was registered in San Pedro, it is there. They keep books of all birth records at the location the birth is registered. They also send copies records to Santo Domingo every so often, but each office keep the books. They don't send the only copy to Santo Domingo.

I'm guessing they are lazy or imcompetent in San Pedro and they haven't looked hard enough. If its a late registered birth, it's not in the book they expect it to be in.  If he can find out when his birth was registered, then they can look in the correct book. Those are the people to slip some pesos to.

We had an issue with my Step Daughters BC, it never made it to the central registry in Santo Domingo, but they found it with no problem when we went to Azua.

If you can't get a copy you can try to prove his identity with other supporting documents to the Consulate, like baptism certificate, hospital and school records. You will need 2 records with birth date and parents names plus the cedula.This has worked other places, but since Santo Domingo is different expect to get put on AR while they investigate his identity.  As far as getting  a passport without a BC, I'm not sure how that works.

So based on reading other posts, it is possible that the incorrect date that is currently shown on his cedula may be the date his birth was registered.  I will suggest that he go back to San Pedro and have them look there.  Although that does not make sense because he says the year shown on his id makes him much older than he really is.  He said they told him that the person that kept the books was transporting the actual books between San Pedro and Santo Domingo and that the entire book that his bc should have been in was missing.  This did not make any sense to me, but since everything else is so illogical I could not argue based solely on my thinking of how things should work, because I am not Dominican. And what about the passport?  How long does that take?  If he uses the id he has currently, can I change what I put as his birthday to correspond to the wrong date on his cedula?  Or is it too late to make changes like that?

 I am sorry to hear about all this you guys have to go through. IMHO, you should re-schedule your cita. Re-scheduling it may get him here faster than going through with the process and waiting through the AR process because you never know how long that will take.
As far as only going off of the date on his ID, I think that would be a good idea, however, I'll let someone else answer on if you can actually do that now or not, b/c I really don't know.
My husband is from La Romana and he had to get his paperwork from San Pedro. He also had to go there to get the status of his ID changed from single to married. We were married Sept 2008 and he tried to get it changed that same month. But a lot of time passed and he still didn't have his new ID. He had to go back, and long story short, here it is 17 months later and he still doesn't have that other ID. So if you can use the one he has, then I would use that.. How much of a difference is it from his actual birthday?

I think it is off by like 9 years.  He didn't want to use it because he says it would make him look like he's older than 40 and that might make it harder for him when looking for a job.  I am older than he is so I don't really see the problem.  Of course this still does not resolve the orignial issue which is that he has no birth certificate.  Neither with the wrong date nor with the correct date!

ah, 9 years is a lot. I can understand where your SO is coming from. Dominicans have a lot of pride, and I don't know anyone who would want to be thought of as almost a decade older than they really are.

My advice would be for him to try to get a passport with that information.. maybe he can "accidentally lose" the cedula he has and try to get another one. This time making sure they put the right date. Also, it wouldn't be a bad idea to get some legalized affidavits as well. Have his parents/family write attesting to his birthdate, and whoever else you can get one from. He may also want to explain a valid reason why he let his ID go on with the wrong date for all these years.  My SO got his passport in San Pedro and it was actually very fast. So maybe he can try to get one with his proof and let them "know" that he doesn't have his cedula anymore. Hopefully this will work.
So what information did you submit with your I-129F application?

I agree with Mrs. Perez about backing everything up with the passport...My SO has the same problem with the wrong date, but he has known that for years--he, too, is from San Pedro.  Basically, since he was born in the campo, his mother and father waited a whole year (and another sister) before they declared his birth.  Now, he and his sister (who is 11 months younger) have the same, wrong birthdate, and they are twins!  LOL we just train ourselves to always give the official birthdate.

???I know official do remove  books from the "oficialias" BUT they do have to have an account of where it is at all times

He may be offering $$$ to the WRONG person and not getting anything done

I would not however try to reschedule .. it is very difficult to do and you may not get a response in time .. most ALWAYS it is a medical or military reason and they still request that the beneficiary attend

He can not get a passport without a legalized BC .. there may be other ways if BC is not available such as baptismal certificate, confirmation certificate and so on BUT He has to go to the passport office and find out

The wrong date on the BC is infamous in DR and to change it can prove a very difficult and lengthy process so many just USE the wrong date as their DOB anyway and just forget about it

This is simple. Just use what he has now for the visa - YOU CANNOT SCREW AROUND WITH THIS.

Fix the date LATER after he is here, at the Dominican Consulate. End of story. Who the hell cares if he is over 40. I'm 49 and about to get a new job making 75K. In the USA, they cannot ask you your age prior to being hired - it's illegal. No one would know.

Go to Santo Domingo and get one. It doesn't matter what they lost in the mail. SDQ can give you as many of these as you want. I don't see what the issue is. I am sure his birth was registered in SDQ at some point.

Go to Santo Domingo and get one. It doesn't matter what they lost in the mail. SDQ can give you as many of these as you want. I don't see what the issue is. I am sure his birth was registered in SDQ at some point.

May they didn't even try this yet. We don't know what the story is. My guess is that in SDQ they can get a cert no problem.

Tim-  The problem is that he is having problems getting an official birth certificate.  Regardless of the wrong birthdate on his id, they are saying his bc was lost and are now refusing to issue him a new one.
Go to Santo Domingo and get one. It doesn't matter what they lost in the mail. SDQ can give you as many of these as you want. I don't see what the issue is. I am sure his birth was registered in SDQ at some point.

It's not that easy, something like this happened to my mom.  They told her the page in the book was torn and they had no clue where to get it. She had to go through a lot to get a cedula.
May they didn't even try this yet. We don't know what the story is. My guess is that in SDQ they can get a cert no problem.

My understanding of the OP is they went to both Santo Domingo and San Pedro and they both say they don't have it. They are pointing fingers and saying it was lost in transport to Santo Domingo.

We had a problem with my Step Daughters, they didn't have it in Santo Domingo and we had to go to Azua to get it, but they did have it in the book there, so they were able to give us a copy.

Back in September 2009 my fiance started working to get his birth certificate.  He tried to get it from an office in San Pedro but they told him he had to go to Santo Domingo.  He was sent back and forth a few times and then finally was told that it had been lost in transport between the two cities and that due to identity fraud he would have to find evidence of his birth and they would give him a new one.  He went to the hospital where his birth was reported, submitted school records and everything and they told him wait a few weeks and it would be ready.  Now his interview is March 3 and his birth certificate is still not ready.  How can he get a passport and id if they will not issue him a birth certificate?  He has an id currently, but of course the birthday on it is very wrong.  What to do?!?!
Thanks, tgood1, that is exactly what I said in the original post!  He has tried SDQ and they are refusing to issue it because they have no record of the original.  They are saying it must have gotten lost in transit between the two cities.  Now, after all this time, his mom is saying he was not born in San Pedro after all, so I think he is going to try to see if she registered his birth in THAT city and I pray he is able to get it there.
