Hi,

My Dominican fiancee for whom I am submitting a US fiancee K-1 visa application has one minor child that she will bring with her to the US. She was never married to the father of the child, but the father IS listed on the child's birth certificate.

There is no formal custody agreement, and the child currently spends time with both of them, mostly out of convenience due to the mother's work hours, otherwise the child would be with her full time.

The father has already said he will allow the child to leave the country to be with her mother.

Is a simple certified/notarized letter by the father signed in the presence of a lawyer stating that he gives permission for the child to leave the country to live permanently with the mother and her fiance, me, all that is needed?

Or does the father have to sign something that says he releases all custody rights as well?

Do we need copy of father's cedula and copies of his birth certificate as well to satisfy Dominican exit customs and US entrance customs?

Or to leave the country and enter the US is the notarized permission letter all we need along with the approved K-1 visa docs and the child's passport?

There is a legal process that MUST be followed. Your fiance MUST contact a Dominican lawyer to draw up the document that must be signed by the father.
There is no such thing as just getting al letter, etc from him. Once he signs the document, it is then taken before a judge (in the dR)
This process takes about 2-3 weeks, so get started now!!

Ok, thanks, but as for the timing...I have been told that I need a permission letter from the father signed with/notarized by an attorney, AND the critical part here as I say is the timing:  I have been told that it is ONLY GOOD FOR 30 DAYS.  So that means I can't do it now but have to wait until we have the approved K1/2 visas in hand and our flight reservations are 30 days away or less.

So it sounds like I need 2 different things, because you are telling me to get something way ahead of time.

I am all for getting something way ahead of time...but if it expires in 30 days, that is pointless.  So I guess I am still not clear on what exactly we need: one document that is drawn up by a lawyer and signed by the father and then given the stamp of approval by a judge/court; or that document PLUS a permission letter from the father 30 days before we actually fly out of the country on the fiancee visa with the child.

Sorry, don't mean to be a pain with nitpicking on this, but of course I want to know for sure so we get it right and are prepared for quick and easy process when the day comes, and I've gotten conflicting opinions...thank you. 

Anyone who can verify this by having gone through it???  Where the child is from an unmarried mother but the father IS on the birth certificate?

Note again: she was never married to the father of the child; but the father is listed on the birth certificate.  There is no kind of legal custody agreement, since they were never married.  And I am NOT talking about adopting the child here, ONLY about getting the necessary legal docs for the child to permanently leave the country as part of a K1 visa.

I know the link states if it is a 3rd person they need authorization from both but as long as you have something stating you have full guardianship only 1 parent authorization is needed

With my kids I usually give the person they are coming back with a copy of the divorce


1) Si el menor viaja con uno de los padres, deberá tener una autorizaci6n del otro, (one parent authorization of the other)
2) En caso de que el menor viaje con una tercera persona, o línea aérea, ambos padres o tutores deberán autorizar a dicho menor (3rd party authorization of both parents)
3)  Si uno de los padres a fallecido traer copia del Acta de defunción (if a parent died show death certificate)
4)  Si uno de los padres tiene la guarda o custodia del menor, deben traer la sentencia del tribunal competente o del tribunal de menores. (if one parent has guardianship show proof)
5)  si los padres se encuentran en el exterior deben dirigirse al consulado dominicano más próximo y solicitar un poder consular, autorizando la salida del menor con su acompañante. (if parents are in foreign country consular letter required)


OR you can do what I do

Show them the Divorce .. say you have no idea where the bastard is and slip them a $20 rolling on the floor laughing

That is IF I am travelling with them .. if it's a aunt or their grandma i just get the consulate letter Smiley

You guys are way off base here. The document is called Permiso to Travel. It is a legal document signed by a DR judge. It is good for 1 year. We used to have a copy of this document in the download section.
It is still required by law. Yes people get away with slipping them $20 bucks, but if your caught, get ready for a nightmare

Considering the recent situation in Haiti with the Americans trying to take 33 kids across the boarder, things are very very tight right now.... Consider yourself warned

the 20 bucks was at the end of all the legal talk  rolling on the floor laughing

the document is also accepted if done by a Abogado Notario Publico in DR and/or the Dominican Consulate in the United states

Document has to have the child's passport and/or birth certificate number .. the passport/cedula # of the authorizing parent and the passport # of the adult the child is traveling with
It must also have a picture of the child on it w/ stamp

it does not have an expiration date but make sure you travel with copies

Permisos Para Menores

 

Para general conocimiento,  se hace saber que la Dirección General de Migración, amparada en las disposiciones establecidas en las Leyes No.285-04 y 136-03 (Ley General de Migración y Ley que crea el Código del Menor), instituye  los requisitos detallados más abajo, para que todo niño, niña o adolescente  pueda salir del país:

PARA MENORES DE NACIONALIDAD DOMINICANA:

   1.
      Si el (la) menor viaja en compañía del padre y de la madre,  no se requerirá permiso de salida de la DGM. (both parents no permit needed)

   2.
      Si el (la) menor viaja acompañado solamente de uno de sus ascendientes;  es decir, del padre o de la madre, deberá contar con la debida autorización del otro progenitor. (if only one parent permission from absent parent needed)

   3.
       Cuando exista algún conflicto entre el padre y la madre, el interesado deberá presentar una decisión judicial, emitida por una instancia  competente, que  autorice la salida del (de la) menor, debiendo  ser presentada ante la Dirección General de Migración. (if parental conflict exists then legal documentation from judicial proceedings must be presented .. ei. divorce, full custody)

   4.
      En el  caso de que se trate de hijo (a) menor no reconocido por el padre, podrá salir del país, siempre que viaje en compañía de la madre, debiendo presentar original del acta  de nacimiento donde se compruebe la filiación. (if father is not on the BC the minor can travel with mother as long as BC is presented indicating such)

   5.
      En caso de que el (la) menor no reconocido por su padre, vaya  a salir  del país bajo la protección de otra persona o línea aérea,  se requerirá la debida autorización de la madre. (if father not on BC mother must authorize 3rd party to travel with minor)

   6.
      Cuando se trate de un (una) menor, que tanto el padre como la madre hayan fallecidos, la autorización de salida del país, deberá ser hecha por el tutor o tutora del mismo; y en su defecto, por un  Consejo de Familia.

   7.
      Cuando se trate de un (una) menor, que el padre o la madre haya fallecido, no se requerirá permiso de la Dirección General de Migración, siempre que viaje en compañía del sobreviviente, debiendo presentar a las autoridades de migración un original del acta de defunción del finado o finada. 

   8.
      Cuando se trate de un (una)  menor que el padre o la madre resida en el extranjero,  quien otorgue la autorización de salida, deberá hacerlo mediante  una declaración jurada  ante Notario Público  con dos testigos haciendo constar tal situación, debiendo presentarla primeramente a la Procuraduría General de la República y luego a  la Dirección General de Migración, para el permiso correspondiente.

      En todos los casos,  la autorización requerida para la  salida de nuestro territorio de menores, deberá hacerse mediante acto bajo firma privada, debidamente legalizado por un Notario Público, visada por la Procuraduría General de la República, debiendo por último depositarse en la Dirección  General de Migración, donde se otorgará el permiso de salida, previo pago del  servicio prestado.

Hola, tengo una pregunta sobre el tema... resulta que estoy en proceso de visa k1 y ya tenemos cita para 15 de marzo, hace aproximadamente 15 dias obtube a travez de un abogado una autorizacion, para la salida de un menor a los EE.UU, cuando hise la solicitud, el solo me pidio la copia de la cedula del papa y la alta de nacimiento del niño, me dijo que pasara a buscar el documento a los dos dias, porque el tenia que llevarlo a sellar por La Procuraduria General De La Repubica. Claro esta firmado por el papa del niño... bueno el caso es que ya tengo el documento y esta legalizado, mi pregunta es; Ese papel tiene que ser visto por alguen mas, ya sea por migracion, antes de la entrevista? o ese papel, así como esta es suficiente para la entrevista?  espero haberme dado a entender, ya que necesito de sus consejos..

si lo hizo con abogado es suficiente ya legalizado
algunas veces requieren la foto pero profavor asegurate de viajar con la acta de nacimiento de el menor
esta carta es para immigracion en el aeropuerto despues que se chequen con la aerolinea .. algunas veces la aerolinea te pide verlo para asegurarse que la tengan

Thanks. She only had to wait 8 years and 2 months for the cita. Her brother had his a few weeks back and had the visa in his hands 4 days later
