I filed a I-130 form for my dominican wife a few months back and really nothing has transpired.  I am now in the dominican and talked to a dominican attorney (actually an american) and she said that I need to file another I-130 form for the child. 
Is this true or do I need a different form?Huh??

Yes, you must file a seperate I-130 for each. You probably need to write a letter to go with it also, explaining that the two cases need to be joined. How far along is the process for your wife? NOA1? NOA2?

I did know about this web site and would rather drill good teeth than use a attorney.... Grin  I sent in my wife's I-130 form with nothing else but a $355 check.  No other papers, nothing!!  I received the I797C back from the Immigration back in December.   lost
Now I am back in the DR and my wife has been very busy getting many papers together....ie.  official documents for her work, where she has lived for the past 5 years...documents for her mother, father, daughter...the document for our wedding.....everything.  I am going to send all of this with the child's I-130 form asking to join the one I sent back in December...with a cover letter etc.
Another question....do I need to translate all these dominican documents to english?  Can I send copies or do I need the origional?

Wow...it really sucks that you did not find this site before sending your wife's I-130.

Aside from the $355 here is a list of documents you should of had sent:

*Form G-325a- (one for your wife signed by her & one for yourself)
*Passport style photo of your wife and of yourself
*Copy of Marriage Certifiate legalized
*Translation of Marriage Certififate
*Copy of your passport & Birth Certificate
*Divorce decree (if any)
*Copy of wife's Birth Certificate legalized
*Translation of wife's BC
*Copy of child's BC legalized & translated
*Any other evidence of bonafied marriege (statements from witness of marriage, bank accounts you might have together, etc.)

You do have to file a separate I-130 for child and pay another fee of $355. I did the same and the cases were just joined now at the NVC.

For the child you should send:

*Copy of MC legalized & translated
*Copy of divorce
*Copy of USC passport & BC
*Copy of child's BC legalized & translated
*Copy of wife's BC legalized & translated

The mods can help you more as to what to regardign the docs that you were supposed to send, but I think that eventually USCIS will contact you requesting more evidence.

All documents that are in Spanish must be translated to English. You do not need to send evidence of work or where she lives. Only evidence of an on going relationship. You should be looking for an RFE, you'll get one and I'm suprised you haven't gotten one already if the only the you sent was the I-130.

Look at the list jprincez has provided. You will get an RFE for most of it on your wife's petition, and most of it needs to be duplicated for the child's petition!

DO NOT use Dominican attorneys, American born or not. This is NOT a Dominican process. Many people think that somehow the Dominican Government is holding them in. The real truth is the AMERICAN government won't let them in HERE without a visa issued by the USA, NOT the Dominican Government. You do not need an attorney at all for this process.

Now I am ready to send all this info out..........
Can I make copies of all the legal documents and send or do I send the origionals?  Mainly the BC of Fior and her daughter and the marriage certificate!
I did just notice that the document of our marriage certificate.....they spelled my last name wrong.....missed it by a letter......unbelieveable. Angry
Oh well, with the help of the board, I was told not to worry about it with my initial and just get it fixed before the interviews.........

That happened on my MC, except it was with my father's last name.  What you have to do is go to the Oficialia Civil and find out if they spelled it wrong on the ORIGINAL paper in the book.  I KNEW that I had checked it over enough, and yet when I went to get a copy, they got the copy wrong.  If it was their error on the copy, they won't charge you to change it (at least that was my case after I gave them an earful).  Good luck!

You do not need a G325a for the 9 year old. BUT, you should include a duplicate of the G325a for the mother AND yourself in the child's I-130 petition, as well as a copy of your MC.
